The WCAB is making proposed changes to the policies and procedures that would allow for a permanent option for virtual hearings. The proposed changes would also address electronic filings that have been used since the Covid-19 pandemic started. While there are definite benefits to the virtual hearings, including the elimination of travel costs, the could also be some drawbacks. The proposals would allow for possible "live" hearings or trials if either party files a written objection and can show good cause.
There will be public hearings regarding the proposed changes on September 24, 2021 from 9:00am until 4:00pm, or until the meeting ends. You can attend the virtual meeting here using password 211916. Or by telephone by dialing 404-443 6397 or 877-336-1831 and entering conference code 852415.
Under the proposal, any WCAB matter could be heard during an electronic hearing, and either party in a case would be able to object to a virtual meeting by filing a written objection and “showing good cause” after learning that a hearing is scheduled to be conducted electronically.
