Applicant sued employer alleging employer's negligent maintenance of a home they provided him resulted in a fire on Aug. 1, 2003, that caused him to suffer severe burns.

A trial judge found that the defendants were immune to civil liability because of the exclusive remedy provisions of the workers’ compensation law.

The Court of Appeal for the 5th District of California explained in a Feb. 10 unpublished decision that the Labor Code generally limits a worker to the recovery of workers’ compensation benefits for on-the-job injuries by immunizing the employer from civil liability.
